Please review these Terms of Service carefully before utilizing the digital services, admission forms, or online communication portals of New City Montessori School ("NCMS", "the School", "our"), situated at Rd No. 3, Kamrauli, Utelwa, Jagdishpur, Amethi, Uttar Pradesh. By accessing or using this website (newcitymontessorischool.in), you unconditionally accept and agree to be bound by these legal terms.

Acceptance of Agreement & Eligibility

By accessing, browsing, or submitting data through this portal, you affirm that:

  • You are of legal age (at least 18 years) competent to contract under the Indian Contract Act, 1872.
  • Where you are submitting admission inquiries, documents, or declarations on behalf of a minor student, you are the lawful biological parent or court-appointed legal guardian of the child.
  • You agree to comply with all applicable local, state, and national laws and regulations governing educational institutions in the State of Uttar Pradesh and the Republic of India.

Accuracy of Admission Information & Legal Declaration

Statutory Warning against Forgery or Misrepresentation

Submission of fabricated documents, altered birth certificates, counterfeit marksheets, or false transfer certificates (TC) constitutes a criminal offense under the Bharatiya Nyaya Sanhita (BNS) / Indian Penal Code.

  • All information entered in the Online Admission Form must be completely truthful, authentic, and verifiable against government-issued records.
  • Any intentional concealment or discrepancy identified during document scrutiny or physical verification will result in immediate disqualification of the application or cancellation of admission without any refund.
  • Submission of an online application does not automatically confer a legal right to admission; final admission is subject to seat availability, document verification, and compliance with school admission criteria.

Fee Regulations & Institutional Policies

  • Fee Schedules: School fees, registration charges, and examination costs must be paid within stipulated timelines as notified in the school calendar or official circulars.
  • Non-Refundable Charges: Prospectus fees, registration processing charges, and admission confirmation fees are strictly non-refundable once processed.
  • Fee Revision: School fee structures are subject to periodic review in strict compliance with the Uttar Pradesh Self-Financed Independent Schools (Fee Regulation) Act and regulatory circulars.

Code of Conduct, Anti-Ragging & Child Protection (POCSO)

New City Montessori School enforces a zero-tolerance policy against misconduct, discrimination, and student harassment:

Anti-Ragging / Anti-Bullying Mandate: In accordance with Supreme Court guidelines and CBSE / state norms, bullying, ragging, or physical/mental harassment in any form (physical, verbal, or digital cyber-bullying) is strictly prohibited.
POCSO Act 2012 Compliance: The school maintains an active Internal Committee for Child Protection. Any conduct compromising child safety will be immediately reported to competent child welfare and statutory authorities.
Respectful Parental Communication: Parents and guardians are expected to communicate with school leadership and faculty with dignity, mutual respect, and decorum.

Intellectual Property & School Media Rights

  • The name "New City Montessori School", the institution crest/logo, official photographs, syllabus designs, study materials, video recordings, and publications are protected under the Indian Copyright Act, 1957 and Trademarks Act, 1999.
  • No individual may reproduce, copy, distribute, or adapt any website media, student photographs, or administrative materials without express written authorization from the school management.
  • Photographs of school events, sports meets, and student accomplishments are displayed with lawful parental consent solely for celebrating student achievements and documenting campus life.

Digital Safety & Cyber Law Compliance (IT Act, 2000)

Users agree not to:

  • Engage in unauthorized data extraction, automated scraping, or denial-of-service attempts targeting school servers.
  • Transmit malware, viruses, or corrupt payload files through the online document upload fields.
  • Attempt to compromise or bypass administrative authentication or student database safeguards. Violators face civil and criminal liability under Sections 43, 65, and 66 of the Information Technology Act, 2000.

Governing Law & Exclusive Jurisdiction

These Terms of Service, their interpretation, validity, and any disputes arising out of or in connection with the use of the school website or admission services shall be governed exclusively by the substantive laws of the Republic of India.

The parties irrevocably submit to the exclusive jurisdiction of the competent Courts of Civil and Criminal Law in District Amethi, Uttar Pradesh, and the Hon'ble High Court of Judicature at Allahabad (Lucknow Bench), to the exclusion of all other courts.

Severability & Amendments

If any provision of these Terms is deemed unlawful or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The School reserves the right to modify these regulations as necessitated by changes in statutory legislation or institutional policy.
